Terms and Conditions

Section 1

About These Terms

These terms apply to all individuals who submit an application, complete a screening process, or participate in any interview or assessment activity with The Ambivert's Code Inc. By submitting an application or proceeding through any stage of our recruitment process you agree to these terms.

Section 2

Independent Contractor Status

All roles advertised by The Ambivert's Code Inc. as commission-based roles are structured as independent contractor arrangements. Successful partners operate as independent businesses, use their own business contact information, set their own hours and methods of work, and invoice The Ambivert's Code Inc. for commissions earned. The Ambivert's Code Inc. does not control how partners carry out their business development activities, only the results expected. Partners are responsible for their own tax obligations, business expenses, and compliance with applicable laws.

Section 3

No Guarantee of Partnership

Submitting an application or completing any stage of our recruitment or assessment process does not guarantee an offer, partnership, or any ongoing business relationship. The Ambivert's Code Inc. reserves the right to:

  • Decline any application at any stage without providing reasons
  • Close a recruitment process at any time without proceeding to a partnership offer
  • Adjust the structure or terms of any opportunity at any time prior to a signed agreement
  • Onboard multiple partners for the same opportunity simultaneously
Section 4

Accuracy of Information

By submitting an application you confirm that all information provided including your CV, professional history, responses to screening questions, and video interview answers is accurate, truthful, and not misleading.

The Ambivert's Code Inc. reserves the right to withdraw any offer or terminate any contractor agreement if information provided during the recruitment process is found to be inaccurate or misleading.

Section 5

Video Interview and Assessment

As part of our recruitment process we may invite shortlisted applicants to complete a video interview. By proceeding with the video interview you consent to:

  • Your video responses being recorded and stored securely
  • Your recordings being reviewed by The Ambivert's Code Inc. recruitment team
  • Your recordings being retained for up to 6 months after the conclusion of the recruitment process unless you request earlier deletion

Video recordings are stored securely using cloud storage providers and are not shared with any third parties outside of the recruitment process.

Section 6

Intellectual Property

Any materials submitted as part of the application process including work samples, proposals, or presentations remain the property of the applicant. By submitting them you grant The Ambivert's Code Inc. a limited right to review and assess them for recruitment purposes only.

Section 7

Communication

All communication during the recruitment process will be conducted via email. The Ambivert's Code Inc. is not responsible for communications lost, delayed, or misdirected due to technical issues outside our control.

Section 8

Third Party Platforms

The Ambivert's Code Inc. uses third party platforms in the administration of our recruitment process including LinkedIn, Resend, Supabase, and Cloudflare. Use of these platforms is subject to their respective terms and privacy policies.

Section 9

Limitation of Liability

To the fullest extent permitted by applicable law The Ambivert's Code Inc. shall not be liable for any loss, cost, or expense incurred by any applicant in connection with the recruitment process including time spent preparing applications or completing assessments.

Section 10

Governing Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes arising from the recruitment process shall be subject to the exclusive jurisdiction of the courts of Ontario. If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Section 11

What Information We Collect

During the recruitment process we may collect the following personal information:

  • Full name and contact details including email address and location
  • Professional history, qualifications, and experience as provided in your CV or resume
  • LinkedIn profile URL and publicly available professional information
  • Responses to screening questions
  • Video recordings of interview responses
  • Any other information you voluntarily provide during the process

How We Use Your Information

We use your personal information solely for the following purposes:

  • Evaluating your suitability for the opportunity you applied for
  • Administering the recruitment and assessment process
  • Communicating with you about your application
  • Making partnership decisions
  • Complying with our legal obligations

We do not use your information for any other purpose without your explicit consent.

Section 13

Legal Basis for Processing

We process your personal information on the basis of your consent given when you submit your application and agree to these terms. You may withdraw your consent at any time by contacting hello@theambivertscode.com. Withdrawing consent means we will cease processing your information and will delete it in accordance with our retention policy.

Section 14

Data Storage and Security

Your application data and interview responses are stored securely using Supabase, a cloud database provider operating with industry-standard security practices. Video recordings are stored in Cloudflare cloud storage with access restricted to authorised personnel only.

We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, or misuse.

Section 15

Data Retention

We retain personal information collected during recruitment for the following periods:

  • Unsuccessful applicants who have not consented to future contact: deleted within 6 months of the conclusion of the recruitment process
  • Unsuccessful applicants who have consented to future contact: retained for up to 24 months
  • Video recordings: deleted within 6 months of submission regardless of outcome
  • Successful applicants who proceed to a contractor agreement: retained for the duration of the business relationship and as required by applicable law thereafter

You may request deletion of your data at any time by emailing hello@theambivertscode.com with the subject line: Delete My Recruitment Data.

Section 16

Future Opportunities

If you have explicitly consented to being contacted about future opportunities we may reach out when a relevant opportunity becomes available. This consent is entirely optional and does not affect your application in any way.

You may withdraw this consent at any time by emailing hello@theambivertscode.com with the subject line: Withdraw Recruitment Consent.

Section 17

Your Rights Under PIPEDA

Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy legislation you have the right to:

  • Know why we are collecting your personal information
  • Access the personal information we hold about you
  • Request correction of inaccurate or incomplete information
  • Withdraw consent for the collection, use, or disclosure of your information
  • Request deletion of your information subject to our legal obligations
  • File a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated

Section 18

Third Party Sharing

We do not sell, rent, or share your personal information with third parties for marketing or commercial purposes. We may share your information with service providers who assist us in administering the recruitment process strictly on a need-to-know basis and subject to confidentiality obligations.

Cookies and Tracking

Our recruitment pages may use cookies and analytics tools to understand how applicants interact with our website. No personally identifiable information is collected through cookies without your consent.
